Terms and Conditions for Van Vibe

1. Introduction

Welcome to Van Vibe (“we”, “us”, “our”). By downloading, installing, accessing, or using our mobile application (“App”), you agree to these Terms and Conditions (“Terms”). If you do not agree, you must not use the App.

You are also responsible for ensuring that all persons who access our Service through your internet connection are aware of these Terms and other applicable terms and conditions, and that they comply with them.

Our Privacy Policy, available at https://vanvibe.co.uk/privacy-policy/, and our Terms of Use, available at https://vanvibe.co.uk/terms-and-conditions/, form part of these Terms. Please review them carefully.

2. Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the App. By agreeing to these Terms, you represent and warrant that you meet this requirement.

3. Licence Grant

Subject to your compliance with these Terms and applicable store policies, we grant you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the App for personal, non-commercial purposes on compatible devices.

4. App Store and Google Play Compliance

  • You acknowledge that these Terms are between you and Van Vibe and not with Apple Inc. or Google LLC. Apple and Google are not responsible for the App or its content.
  • You agree that Apple’s and Google’s respective policies govern your use of the App through their stores, including any in-App purchases.
  • Apple and Google have no obligation to furnish any maintenance or support services with respect to the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google and they may refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple and Google have no other warranty obligation with respect to the App.
  • Apple and Google are not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
  • In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Van Vibe, and not Apple or Google, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
  • You represent and warrant that (i) you are not located in a country that is subject to a UK or US Government embargo, or that has been designated by the UK or US Government as a “terrorist supporting” country; and (ii) you are not listed on any UK or US Government list of prohibited or restricted parties.

5. User Accounts and Registration

To access certain features, you may create an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

5.1. Free Account Storage Limit

Free accounts are limited to a maximum of 3 GB of total storage for User Content. If you reach this limit, you will need to delete existing content or upgrade to a paid plan to store additional data.

5.2. Account Deletion

You may request deletion of your account at any time from within the App. Upon account deletion, we will delete or anonymise your personal data in accordance with our Privacy Policy, except where we are required by law to retain certain information. Deletion of your account will result in the permanent removal of your User Content, including all images (both public and private), comments, and likes associated with your account. This action cannot be undone.

6. User Content

You are solely responsible for all content you submit via the App (“User Content”), including photographs, comments, and likes. User Content may be designated as public (visible to the Van Vibe community) or private (visible only to you). By submitting User Content, you grant us a worldwide, royalty-free, sublicensable, and transferable licence to use, reproduce, distribute, and display it in connection with App operations, including displaying public User Content to other users of the App.

You retain ownership of your User Content. However, you acknowledge that public User Content may be viewed, liked, and commented on by other users of the App.

7. Social Features and Community Guidelines

The App includes social features that allow users to share public images of their campervan and motorhome adventures, and to like and comment on other users’ public posts. When using these features, you must comply with our community guidelines and these Terms.

We provide the following tools for user safety:

  • A method for filtering objectionable material from being posted to the App.
  • A mechanism to report offensive content, with timely responses to concerns.
  • The ability to block abusive users from the service.
  • Published contact information so users can easily reach us (info@vanvibe.co.uk).

8. Prohibited Conduct

You agree not to:

  • Violate any law or third-party rights.
  • Harass, abuse, or harm others.
  • Upload viruses, malware, or harmful code.
  • Reverse engineer, decompile, or modify the App.
  • Use the App to send unsolicited communications or spam.
  • Post inappropriate content, including hate speech, harassment, sexually explicit material, graphic violence, or any other content we deem offensive; such content is strictly prohibited and will be removed at our discretion.

9. Intellectual Property

All rights, title, and interest in and to the App, including all content, graphics, and trademarks, are owned by Van Vibe or our licensors. These Terms do not grant you any rights to our intellectual property beyond the licence in Section 3.

10. In-App Purchases and Subscriptions

Certain features of the App may require payment through in-App purchases or subscriptions. All in-App purchases and subscriptions are processed through the Apple App Store or Google Play Store. Refunds, billing, and subscription management are subject to their respective store policies.

10.1. One-Off In-App Purchases

The App offers the following one-off (non-recurring) in-App purchases:

  • Premium Post Listing (Boost Post): £9.99 for a 2-week period. This is a one-off purchase that promotes your post to the main home screen feed for greater visibility, engagement, and community reach. The boost lasts for 2 weeks from the date of purchase and does not automatically renew. Once the 2-week period expires, your post will return to standard visibility. You may purchase a new boost at any time.

10.2. Auto-Renewable Subscriptions

The App offers the following auto-renewable subscription plans:

  • Club Premium: £49.00 per year. This subscription gives your club listing a crown badge, featured placement in the boosted carousel, priority in search results, a full photo gallery, a larger pin on the map, and 12 months of enhanced visibility. Your subscription will automatically renew every 12 months unless cancelled.
  • Premium Event Listing: £99.00 per year. This subscription gives your event listing a crown badge, featured placement in the boosted carousel, priority in search results, a full photo gallery, a larger pin on the map, and 12 months of enhanced visibility. Your subscription will automatically renew every 12 months unless cancelled.

10.3. Auto-Renewal Terms (Club Premium and Premium Event Listing)

By subscribing to Club Premium or Premium Event Listing, you agree to the following terms:

  • Payment: Your subscription will be charged to your Apple ID account (iOS) or Google Play account (Android) at confirmation of purchase.
  • Auto-Renewal: Your subscription will automatically renew every 12 months unless auto-renewal is turned off at least 24 hours before the end of the current period. Club Premium renews at £49.00 per year. Premium Event Listing renews at £99.00 per year.
  • Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen subscription plan.
  • Managing Your Subscription: You can manage your subscription and/or turn off auto-renewal by visiting your account settings in the Apple App Store or Google Play Store after purchase.
  • Cancellation: The current subscription period may not be cancelled during an active subscription period; however, you may turn off auto-renewal at any time. Cancellation will take effect at the end of the current billing period, and you will retain access to premium features until that date. Removing the App from your device does not automatically cancel your subscription.
  • Free Trials: If a free trial period is offered, any unused portion of the free trial will be forfeited when you purchase a subscription.
  • Price Changes: We may change subscription prices from time to time. Any price change will take effect at the start of the next subscription period following the date of the price change. If you do not agree with a price change, you may cancel your subscription before it renews.

11. Third-Party Services

The App may include integrations with third-party services (e.g., analytics, advertising, payment processors). Your use of those services is governed by their respective terms and privacy policies.

12. Push Notifications

With your permission, we may send you push notifications. You can disable notifications in your device settings; disabling critical alerts may limit App functionality.

13. Warranty Disclaimer

The App is provided “as is” and “as available” without warranties of any kind. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, Van Vibe and its affiliates are not liable for any indirect, incidental, special, or consequential damages arising out of your use of the App, even if advised of the possibility of such damages.

15. Indemnification

You agree to indemnify and hold Van Vibe, its officers, directors, employees, and agents harmless from claims, damages, losses, liabilities, costs, and expenses arising out of your use of the App or violation of these Terms.

16. Termination

We may suspend or terminate your access if you breach these Terms or for any reason. Upon termination, the licence granted in Section 3 will end, and you must cease all use of the App. Termination of your account does not automatically cancel any active subscriptions. You must cancel your subscription through your Apple App Store or Google Play Store account settings to avoid continued billing.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales without regard to conflict of law principles. You agree to the exclusive jurisdiction of the courts located in London for any disputes.

18. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via in-App notice or email before they take effect. Continued use after changes indicates acceptance.

19. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force.

20. Apple and Google as Third-Party Beneficiaries

You acknowledge and agree that Apple Inc. and Google LLC are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
